This website is owned and operated by E-Bike USA LLC, a limited liability company organized under the laws of the State of Georgia, doing business as eBike Empire.

By visiting our website, creating an account, or placing an order, you agree to be bound by these Terms of Service along with our Privacy Policy, Return and Refund Policy, and Shipping Policy, all of which are incorporated into these Terms by reference. If you do not agree with any part of these Terms, please do not use our website or purchase our products.

1. Eligibility

By using our website, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract under the laws of your jurisdiction. If you are using our website on behalf of a business or legal entity, you confirm that you have the authority to bind that entity to these Terms.

We reserve the right to refuse service, cancel orders, close accounts, or restrict access to any user at our sole discretion, including for suspected fraud, abuse, or violation of these Terms.

2. Account Registration

You may browse our website without creating an account. However, certain features including order history, saved preferences, and faster checkout require registration. When you create an account, you agree to provide accurate, current, and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. 3. Products and Availability

eBike Empire offers a curated selection of electric bikes, electric dirt bikes, batteries, controllers, conversion kits, replacement parts, and related accessories from trusted brands including Aventon, Heybike, ENGWE, Sur-Ron, SAMEBIKE, VIPCOO, Coswheel, Lankeleisi, 79Bike, and Ventus, among others.

All product descriptions, specifications, images, and pricing on our website are provided for informational purposes and are subject to change without notice. Product availability is not guaranteed. Items may sell out, be discontinued, or become temporarily unavailable at any time. We reserve the right to limit quantities, refuse orders, or discontinue products at our sole discretion.

4. Pricing and Payment

All prices are listed in United States Dollars. Prices are subject to change without prior notice but changes will not affect orders that have already been confirmed. We accept Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay, PayPal, Affirm, and Klarna where available.

By providing payment information, you represent that you are authorized to use the selected payment method and authorize us to charge the full amount of your order including applicable taxes and any other fees disclosed at checkout. If your payment cannot be processed, your order will not be confirmed. In the event of a pricing error on our website, we reserve the right to cancel any affected order and issue a full refund.

Sales tax will be calculated and applied to orders shipped to states where E-Bike USA LLC is legally required to collect tax, in accordance with applicable state and local laws.

5. Orders and Order Confirmation

Placing an order on ebikeempire.com constitutes an offer to purchase, which we may accept or decline at our discretion. Your order is not confirmed until you receive an order confirmation email from us. A shipping confirmation email with your tracking number confirms that your order has been dispatched.

We reserve the right to refuse or cancel any order for reasons including product unavailability, pricing errors, suspected fraudulent activity, or any other reason at our sole discretion. If your order is cancelled after payment has been collected, we will issue a full refund to your original payment method.

6. Shipping and Delivery

We ship all orders from our warehouse in Dalton, Georgia. We offer free shipping on all orders to all 50 United States including Alaska and Hawaii. Standard delivery for in-stock items takes 5 to 8 business days from the date of shipment. You will receive a tracking link by email as soon as your order leaves our warehouse.

Delivery timeframes are estimates and are not guaranteed. We are not responsible for delays caused by the carrier, weather conditions, natural disasters, holidays, or other circumstances beyond our control. Risk of loss and title for items purchased pass to you upon delivery to the carrier. Please review our Shipping Policy for complete details.

7. 30-Day Risk-Free Trial

Every electric bike purchased from ebikeempire.com comes with a 30-day risk-free trial. If the bike is not the right fit for you, contact us within 30 days of your delivery date and we will arrange the return and issue a full refund, provided all return conditions are met. 8. Warranty

Every electric bike sold through eBike Empire is backed by a 2-year manufacturer warranty covering defects in materials and workmanship under normal use. This warranty is provided by the manufacturer and applies in addition to your 30-day risk-free trial.

Warranty coverage does not extend to normal wear and tear, damage caused by misuse or improper assembly, unauthorized modifications, accidents, or use inconsistent with the manufacturer guidelines. 9. Product Safety and Legal Compliance

Electric bikes and related products sold through our website are subject to federal, state, and local regulations that vary by jurisdiction. It is your sole responsibility to verify that any product you purchase is legal to own and operate in your jurisdiction before completing your purchase, to comply with all applicable laws regarding registration, licensing, insurance, helmet use, age restrictions, and permitted riding locations, and to read and follow all manufacturer instructions, warnings, and user manuals prior to operating any product.

Certain products sold on our website including high-powered electric dirt bikes and off-road electric motorcycles are designed for off-road use, private property, or closed courses only and may not be street-legal in your jurisdiction. By purchasing and using any product from our website, you assume all risk associated with its operation and agree that eBike Empire and E-Bike USA LLC are not responsible for any injury, damage, fine, legal consequence, or loss arising from your use of the product.

10. Prohibited Uses

You agree to use our website only for lawful purposes and in accordance with these Terms. All manufacturer brand names, logos, and product names appearing on our website including Aventon, Heybike, ENGWE, Sur-Ron, and others are the property of their respective owners and are used solely to identify the products we offer for sale.

You may view, download, and print pages from our website for your personal, non-commercial use only. You may not reproduce, republish, distribute, modify, or create derivative works from any content on our website without our prior written consent.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our website shall not exceed the greater of one hundred dollars or the total amount you paid us for the product or service giving rise to the claim in the six months preceding the event that gave rise to liability.

15. Indemnification

You agree to defend, indemnify, and hold harmless E-Bike USA LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses including reasonable attorneys fees arising out of or relating to your violation of these Terms, your use or misuse of our website or any product purchased through it, your violation of any third-party right, or your violation of any applicable law or regulation.

16. Governing Law

These Terms and any dispute arising out of or relating to them or your use of our website shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Whitfield County, Georgia, and you consent to the personal jurisdiction and venue of those courts.

17. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at contact@ebikeempire.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any issue within 30 days of receiving your written notice. If the dispute cannot be resolved informally, any claim shall be resolved through binding individual arbitration administered by the American Arbitration Association, except that either party may bring a qualifying claim in small claims court where jurisdiction and venue are proper.

You and E-Bike USA LLC agree that each party may only bring claims in an individual capacity and not as a plaintiff or class member in any class action or representative proceeding.

18. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, carrier delays, or failures of third-party service providers.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it will be severed from these Terms. The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement between you and E-Bike USA LLC regarding your use of our website and supersede all prior agreements, representations, and understandings relating to the same subject matter.

21. Changes to These Terms

We reserve the right to modify or update these Terms of Service at any time at our sole discretion. When we make changes, we will update the effective date at the top of this page. Your continued use of our website after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our website.
