These Terms of Service ("Terms") govern your access to and use of the website located at ebikeempire.com (the "Site") and any products, services, or content offered through the Site. The Site is owned and operated by E-Bike USA LLC, a limited liability company organized under the laws of the State of Georgia ("eBike Empire," "we," "us," or "our").

By accessing or using our Site, browsing our products, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Return and Refund Policy, Shipping Policy, and Warranty Policy, all of which are incorporated by reference. If you do not agree with any part of these Terms, please do not use our Site or purchase our products.

Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations, including a limitation of liability and a governing law clause.

1. Eligibility

By using our Site, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding contract under the laws of your jurisdiction. If you are using the Site on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to refuse service, terminate accounts, cancel orders, or restrict access to any user at our sole discretion, including for suspected fraud, abuse, misuse, or violation of these Terms.

2. Account Registration

You may browse the Site without creating an account, but certain features, including order history and saved preferences, require registration. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You may not create an account using another person's information, share your account credentials, or transfer your account to any third party without our written consent.

3. Products and Availability

We offer a curated selection of electric bikes, batteries, controllers, conversion kits, parts, and related accessories from manufacturers including Aventon, Heybike, ENGWE, Sur-Ron, SAMEBIKE, VIPCOO, Coswheel, Lankeleisi, 79Bike, and Ventus, among others. All product descriptions, specifications, images, and prices are provided for informational purposes and are subject to change without notice.

While we make every effort to display product colors, dimensions, features, and specifications accurately, we cannot guarantee that your device's display will render colors precisely, and minor variations may occur.

Product availability is not guaranteed. Items may sell out, be discontinued, or be temporarily unavailable, and we reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.

4. Pricing and Payment

All prices are listed in United States Dollars (USD) unless otherwise specified. Prices are subject to change at any time without prior notice, but changes will not affect orders that have already been placed and confirmed.

We accept major credit cards, debit cards, PayPal, Shop Pay, Apple Pay, Google Pay, and third-party financing options such as Affirm and Klarna, where available. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full amount of your order, including applicable taxes, shipping charges, and any other fees.

If your payment cannot be processed, your order will not be completed. In the event of a pricing error, typographical error, or product listing error, we reserve the right to cancel any affected order, even after order confirmation, and to issue a full refund.

Sales tax will be added to orders shipped to states where E-Bike USA LLC is required to collect tax, in accordance with applicable state and local laws.

5. Orders and Order Acceptance

Placing an order through our Site constitutes an offer to purchase, which we may accept or decline at our discretion. Your order is not confirmed until you receive an order confirmation email from us. A shipping confirmation email indicates that your order has been dispatched.

We reserve the right to refuse or cancel any order for reasons including, but not limited to:

  • Product availability or pricing errors
  • Suspected fraudulent activity or unauthorized use of payment methods
  • Shipping address restrictions
  • Violation of these Terms
  • Suspected resale, bulk purchase for resale, or purchase in violation of manufacturer agreements
  • Any other reason at our sole discretion

If your order is cancelled after payment, we will issue a full refund to your original payment method.

6. Shipping and Delivery

We ship from our warehouse in Dalton, Georgia to addresses within the continental United States unless otherwise noted. Standard delivery times are typically 5–8 business days from the date of shipment for in-stock items, though delivery times may vary based on carrier delays, weather, holidays, and other factors outside our control.

Risk of loss and title for items purchased pass to you upon our delivery to the shipping carrier. It is your responsibility to inspect all deliveries upon receipt and report any damage or missing items within 48 hours.

7. Returns and Refunds

We offer a 30-day risk-free trial on eligible ebikes purchased directly from ebikeempire.com. Additional conditions, restocking fees, and exclusions apply. Please review our Return and Refund Policy for complete details, including how to initiate a return, timelines, and eligibility requirements.

8. Warranty

Most ebikes sold through eBike Empire are covered by a manufacturer warranty of up to 2 years, which covers defects in materials and workmanship under normal use. Warranty coverage varies by brand and product, and is provided by the manufacturer, not by eBike Empire directly.

Warranty coverage does not extend to normal wear, damage caused by misuse, improper assembly, unauthorized modifications, accidents, or use inconsistent with manufacturer guidelines. Please review our Warranty Policy for full details and manufacturer-specific terms.

9. User Conduct and Prohibited Uses

You agree to use our Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
  • Engage in any conduct that restricts, disrupts, or inhibits any other user's use of the Site
  • Attempt to gain unauthorized access to any portion of the Site, other user accounts, or connected systems or networks
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission
  • Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity
  • Interfere with the proper working of the Site or bypass any security features
  • Collect or harvest any personal information from other users
  • Use the Site to advertise, solicit, or transmit any commercial content without our prior written consent
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Site
  • Use the Site or any product purchased through it in a manner that violates any manufacturer restriction or resale agreement

We reserve the right to investigate and take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Site.

10. Product Use, Safety, and Legal Compliance

Electric bikes and related products sold on our Site are subject to local, state, and federal laws that vary by jurisdiction. It is your sole responsibility to:

  • Confirm that any product you purchase is legal to own and operate in your jurisdiction
  • Comply with all applicable laws regarding registration, licensing, insurance, helmet use, age restrictions, and permitted riding locations
  • Understand the classification of your ebike (Class 1, 2, 3, or off-road only) and use it only where legally permitted
  • Wear appropriate safety gear at all times
  • Read and follow all manufacturer instructions, warnings, and user manuals

Certain products, including but not limited to high-powered electric dirt bikes and off-road motorcycles, are intended for off-road, private property, or closed course use only. These products may not be street-legal in your jurisdiction. Riding an off-road-only vehicle on public roads may result in fines, impoundment, or personal injury.

By purchasing and using any product from our Site, you assume all risk associated with its use and agree that eBike Empire is not responsible for any injury, damage, fines, or legal consequences arising from your use of the product.

11. Intellectual Property Rights

All content on the Site — including but not limited to text, graphics, logos, icons, images, photographs, illustrations, product descriptions, marketing copy, page layouts, and software — is the property of E-Bike USA LLC or its content suppliers and licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

"eBike Empire" and the eBike Empire logo are trademarks of E-Bike USA LLC. All other trademarks, product names, brand names, and logos appearing on the Site, including manufacturer trademarks such as Aventon, Heybike, ENGWE, and Sur-Ron, are the property of their respective owners and are used solely to identify the products offered for sale.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without our prior written consent, except that you may temporarily display or print portions of the Site for your personal, non-commercial use.

12. User Submissions and Reviews

If you submit reviews, comments, feedback, suggestions, photos, or other content to the Site ("User Content"), you grant E-Bike USA LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media, in connection with our business.

You represent and warrant that any User Content you submit:

  • Is your own original work or you have all necessary rights to submit it
  • Does not infringe any third party's intellectual property, privacy, or other rights
  • Is not false, misleading, defamatory, obscene, or otherwise unlawful
  • Does not contain viruses, malware, or harmful code

We reserve the right, but are not obligated, to review, edit, or remove any User Content at our sole discretion.

13. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources, including manufacturer sites, financing providers, review platforms such as Trustpilot, and social media platforms. These links are provided for your convenience and do not imply our endorsement, approval, or verification of the linked content.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You access third-party sites at your own risk and subject to their terms and policies.

14. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS, SERVICES, AND CONTENT AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

WHILE WE STRIVE TO PROVIDE ACCURATE PRODUCT INFORMATION, WE DO NOT WARRANT THAT PRODUCT DESCRIPTIONS, PRICING, OR OTHER CONTENT ON THE SITE IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE.

MANUFACTURER WARRANTIES FOR PRODUCTS SOLD ON THE SITE ARE PROVIDED BY THE MANUFACTURER AND ARE THE SOLE WARRANTY APPLICABLE TO THE PRODUCT. eBIKE EMPIRE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO PRODUCTS SOLD ON THE SITE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL eBIKE EMPIRE, E-BIKE USA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, PERSONAL INJURY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE
  • ANY PRODUCT PURCHASED THROUGH THE SITE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • ANY OTHER MATTER RELATING TO THE SITE OR THESE TERMS

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

16. Indemnification

You agree to defend, indemnify, and hold harmless E-Bike USA LLC, its affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use or misuse of the Site or any product purchased through it
  • Your violation of any third party's rights, including intellectual property, privacy, or property rights
  • Your violation of any applicable law or regulation
  • Any User Content you submit

17. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Whitfield County, Georgia, and you consent to the personal jurisdiction and venue of those courts.

18. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at contact@ebikeempire.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any dispute within 30 days of receiving your notice.

If we are unable to resolve the dispute informally, any claim shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may bring a claim in small claims court where jurisdiction and venue are proper.

YOU AND eBIKE EMPIRE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

19. Termination

We reserve the right to terminate or suspend your access to the Site, your account, or any service, at our sole discretion, at any time, without notice, and without liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, all provisions of these Terms which by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

20. Force Majeure

We will not be liable or responsible for any failure or delay in the performance of any of our obligations under these Terms caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

21. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

22. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and Warranty Policy, constitute the entire agreement between you and eBike Empire regarding your use of the Site and supersede all prior agreements, understandings, and communications, whether written or oral.

23. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in whole or in part at any time without notice or consent.

24. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of E-Bike USA LLC.

25. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Effective Date" at the top of this page. Material changes may also be communicated by email or through a notice on the Site.

Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
